TERMS AND CONDITIONS – DUQUES DISTRIBUTOR LLC

By making a purchase on www.duquesdistributor.com (hereinafter referred to as “Duques Distributor,” “we,” “us,” “our,” or “the Company”), the customer fully agrees to the following Terms and Conditions. These terms are specifically designed for frozen and moderately perishable bakery products, in accordance with U.S. food industry best practices and general FDA guidelines for frozen foods.


1. CUSTOMER ACCEPTANCE AND RESPONSIBILITY

The customer is responsible for providing accurate, complete, and correct information at the time of purchase, including:

  • Full recipient name

  • Billing and shipping address

  • Apartment, unit, or suite number (if applicable)

  • Access codes or special delivery instructions

  • Valid phone number and email address

  • Correct payment information

Duques Distributor is not responsible for delays, losses, or damages resulting from incorrect or incomplete information provided by the customer.

If the order is sent as a gift, the purchaser is responsible for informing the recipient about these Terms and Conditions and the frozen, perishable nature of the products.


2. PRODUCT NATURE

Our products primarily consist of frozen bakery items, considered moderately perishable foods.

According to accepted FDA practices for frozen foods:

  • Products must be kept frozen after receipt.

  • Product quality and safety depend largely on proper handling after delivery.

⚠️ Mandatory recommendation: The customer or recipient must place the products in the freezer immediately upon delivery.


3. DELIVERY RESPONSIBILITY

Duques Distributor is responsible for the products until the package is delivered to the carrier (USPS Priority Mail).

The recipient is responsible for:

  • Being available on the estimated delivery date

  • Retrieving the package on the same day it is delivered

  • Immediately storing the products properly

Duques Distributor is not responsible for product deterioration caused by:

  • Recipient absence

  • Packages left unattended

  • Failure to refreeze after delivery


4. SHIPPING

All shipments are made exclusively via USPS Priority Mail.

  • Free shipping is included on all BOXES, with no minimum purchase required.

  • Specific delivery times are not guaranteed.

  • Deliveries may occur as late as 10:00 p.m. local time and still be considered “on time.”

  • We do not ship to:

    • PO Boxes

    • Military bases or APO/FPO addresses

    • Puerto Rico


5. ADDRESS VERIFICATION

The customer is fully responsible for entering a valid and deliverable address. No refunds or reshipments will be issued for:

  • Incorrect addresses

  • Closed businesses

  • Typographical errors

Orders containing frozen products cannot be redirected once shipped.


6. FROZEN PRODUCTS – RECEIPT CONDITIONS

During transit, some products may partially thaw.

According to general FDA guidelines:

  • If the product arrives cold to the touch, it may be safely refrozen.

Duques Distributor does not guarantee texture or appearance if the product was not properly stored after delivery.


7. CLAIMS, DAMAGES & DEFECTIVE PRODUCTS

All claims must be submitted within 4 hours of delivery.

The customer must provide:

  • Clear photos of the product

  • Photos of the packaging

  • A description of the issue

Duques Distributor reserves the right to evaluate each case individually and, at its discretion, offer:

  • Replacement

  • Store credit

  • Partial or full refund

Claims will not be accepted for:

  • Improper handling

  • Incorrect storage

  • Claims submitted after the deadline


8. CANCELLATIONS & CHANGES

Orders may be canceled before shipment.

Once the package has been handed over to the carrier, cancellations and refunds are no longer accepted.

Address or delivery date changes may result in additional charges.


9. OUT-OF-STOCK PRODUCTS

If an item becomes unavailable, Duques Distributor may offer:

  • A substitute

  • Store credit

  • A refund

If the customer cannot be reached, the Company will determine the best solution to fulfill the order.


10. PAYMENT POLICY

We accept:

  • Visa

  • MasterCard

  • American Express

  • Discover

All payments are processed at the time the order is placed.


11. PRIVACY POLICY

Duques Distributor protects customer personal information and does not share sensitive data with third parties except as strictly necessary to process payments and shipments.

Consent for SMS and promotional emails is optional and may be withdrawn at any time.


12. GOVERNING LAW

These Terms and Conditions are governed by the laws of the U.S. state in which Duques Distributor LLC is registered, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the courts of that state.
